Who we are and acceptance

Resilience Companion (the “service”) is operated by Cognitive Corp, an Indiana corporation (“Cognitive”, “we”, “us”), for the ISSA Sustainability Committee program delivered with the International Sanitary Supply Association (“ISSA”) and Green2Sustainable, LLC (“G2S”). In these terms, Cognitive, ISSA and G2S, together with their divisions, committees, directors, officers, employees, authors, agents and representatives, are the “Protected Parties”.

By creating an account, buying a subscription, or using the service, you agree to these terms. Account holders are asked to accept these terms and the Privacy Policy before access, and to accept again at their next sign-in after a change; we keep a dated record of each acceptance. If you use the service for an organization, you confirm that you have authority to accept these terms for it, and “you” includes that organization. If you do not agree, do not use the service.

Business use

The service is intended for cleaning-industry businesses and other organizations, and for people acting for them in the course of their work. It provides educational readiness tools, weather information, member workspace features, and optional text alerts. You must be at least 18 years old to create an account.

Not emergency or professional advice

The service is not an emergency-response system, weather authority, insurance certification, legal opinion, or guarantee of preparedness. Follow official National Weather Service, local government, emergency-service, insurer, and employer instructions. Call the appropriate emergency number when immediate help is needed.

Your decisions and assumption of risk

Weather, preparedness and safety information in the service, including forecasts, outlooks, alerts, checklists, action plans and AI-generated answers, is general guidance only. It is not a substitute for official warnings, emergency services, or advice from a qualified professional about your sites, people or operations. Weather data can be late, incomplete or wrong, and alerts may be delayed or not delivered.

You remain solely responsible for your own safety decisions and for those you make for your staff, crews, clients and sites, including whether to work, close, evacuate, shelter or travel. You use the service, and act or decline to act on anything in it, at your own risk.

Program disclaimer

The information presented in Preparing for El Niño and Extreme Weather Events, the Resilience Companion platform, and the Resilience Companion program (collectively, the “Resources”) is provided by the International Sanitary Supply Association, the ISSA Sustainability Committee, Cognitive Corp. and Green2Sustainable (collectively, the “Providers”) for informational and educational purposes only. The Providers make no representations or warranties of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability, or completeness of any information provided, and the Providers expressly disclaim any and all representations and warranties of any kind, including, but not limited to, the warranty of merchantability and fitness for a particular purpose. The information provided in the Resources is not intended to be a substitute for professional advice. You should always seek the advice of a qualified professional with any questions you may have regarding a particular project, process, or situation, including but not limited to laws, regulations, codes, standards, and/or compliance. Any action you take based upon or arising out of any information contained in the Resources is strictly at your own risk. To the fullest extent permitted by applicable law, in no event shall the Providers, or their divisions, committees, directors, employees, authors, agents, or representatives be liable for: (1) any errors, mistakes, or inaccuracies in the content; (2) personal injury and/or property damage, of any nature whatsoever resulting from or arising out of the use of the Resources; or (3) for lost profits or for any special, indirect, incidental, consequential, or punitive damages in connection with the use of the Resources.

AI features

The written assistant and the optional video guide use artificial intelligence. AI output can be inaccurate, incomplete or out of date, and may sound more certain than it is. Check anything important against the handbook, official sources or a qualified professional before relying on it.

The optional video guide is AI-rendered. Tavus and Daily process live audio and call data to provide it. The camera is off by default and is not required; recording and emotion recognition are not enabled. Cross-session memory is optional, off by default, and used only after consent. You can withdraw consent and delete saved memories through the assistant controls.

Text-message program

The Resilience Companion Alerts program sends work-related emergency, weather, site-access, schedule, and operational messages to people enrolled by participating organizations. Message frequency varies based on hazards and manager activity. Message and data rates may apply.

  • Reply STOP to cancel messages at any time.
  • Reply START to resubscribe where supported.
  • Reply HELP for help, or contact the organization that enrolled you.
  • Opt-in details: Work Weather & Emergency Text Alerts.
  • Carriers are not liable for delayed or undelivered messages.

Organization responsibilities

Managers must provide accurate information, enroll only people who have given permission, keep assignments current, honor withdrawal requests, and use messaging only for legitimate work-related readiness and safety purposes. Messages may not include deceptive content, marketing, unlawful material, or unauthorized links. You are responsible for the instructions you give your staff and crews, whether or not they came from the service.

Accounts and acceptable use

You are responsible for your account, access credentials, and activity. Do not misuse the service, interfere with its operation, attempt unauthorized access, or upload content you lack permission to use. You keep ownership of the content you add, and you give us permission to host and process it to provide the service. We may suspend or close an account when needed to protect users, comply with law, enforce these terms, or preserve service integrity.

Subscriptions, cancellation and refunds

Paid features, pricing, billing intervals, renewals, and cancellation terms are presented at checkout. Paid bands are self-declared against your organization’s annual revenue, and you agree to choose the band that applies to you. Payment processing is handled by the displayed payment provider. Subscriptions renew automatically until cancelled. Cancellation stops future renewal; you keep access until the end of the period already paid. Fees are not refunded unless required by law or expressly stated at purchase. Life-safety content stays available on the free tier.

If the ISSA program ends, Cognitive may continue to operate the service on its own, without ISSA’s name or any suggestion of association with ISSA. If you hold a paid subscription at that time, you may choose to continue it directly with Cognitive under Cognitive’s terms; we will tell you what happens to your account, subscription and data, and we will keep your data for that purpose only with your consent.

Warranty disclaimer

The service, its content, and all AI output are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. Weather feeds, telecommunications networks, AI providers, and other third-party services may be delayed or unavailable.

Limitation of liability

To the fullest extent permitted by law: (a) no Protected Party is liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or business opportunity, arising out of or relating to the service or these terms, even if advised of the possibility; and (b) the total liability of the Protected Parties together, for all claims arising out of or relating to the service or these terms, is limited to the greater of the fees you paid for the service in the twelve (12) months before the event giving rise to the claim, or one hundred U.S. dollars (US$100). These limits apply whatever the legal theory, including contract, tort (including negligence) or statute. They do not limit liability that cannot be limited by law, including for fraud, gross negligence or willful misconduct.

Your indemnity

To the fullest extent permitted by law, you will defend, indemnify and hold harmless each Protected Party from and against all third-party claims, and related losses, damages, liabilities, settlements, costs and reasonable attorneys’ fees, arising out of or relating to: (a) your use of the service; (b) decisions made, and actions taken or not taken, by you, your organization, or your staff, crews or contractors, including safety and work decisions, whether or not informed by the service; (c) content or data you or your organization submit, including crew contact details and consent records; or (d) your breach of these terms or of applicable law.

This indemnity applies even where a claim alleges that a Protected Party’s own negligence contributed to the loss, but it does not apply to the extent a loss is finally determined to have been caused by a Protected Party’s gross negligence or willful misconduct. The Protected Party will notify you of the claim, may take part in its defense with counsel of its choosing, and you will not settle any claim that admits fault by, or imposes an obligation on, a Protected Party without its written consent.

ISSA and Green2Sustainable

ISSA and G2S are intended third-party beneficiaries of the sections titled “Your decisions and assumption of risk”, “Program disclaimer”, “Warranty disclaimer”, “Limitation of liability” and “Your indemnity”, and may enforce them directly.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. The state and federal courts located in Cook County, Illinois have exclusive jurisdiction, and you consent to venue there. If any part of these terms is unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect.

Privacy and changes

Use of the service is also governed by our Privacy Policy. We may update these terms and will post the revised date here. Continued use after an update means you accept the revised terms, and account holders will be asked to accept them at their next sign-in.
